2009/04/07 | 2009年4月2日 緊急アピールを発表しました。 ----JPCAからの緊急アピール---（20090402） 本の権利は、出版社が守らなければならない！ Googleは一体、何をしているのでしょうか。 図書館の蔵書から無断でスキャニングし続けているのです。 何の権利が、侵害されているのでしょうか。 スキャニングされた出版物の権利が侵害されているのです。 出版物の権利は誰が持っているのでしょうか。 出版物の権利は、製造者である出版者（社）がもっているはずのものです。 多くの海外の国では、著作者の権利とともに、伝達者の権利としてパブリッシャーズライツ（出版者の権利）を出版社に認めています。Google「和解」案に参加するにしても、あるいは拒否するにしても、当事者として行動できる出版社の権限が法的に保証されています。Googleの行為が、明らかな脱法行為であると訴える権利も、著者と同様に、当該の出版社が当然有しているのです。この件でドイツとフランスで訴訟が起こっていると聞きますが、それも、きわめて、自然な対応です。 しかし、現状の日本の著作権法には、著作と出版物は別のものなのに、出版社に関して伝達者としての権利の規定がありません。出版社の権利が明らかでないのです。そのため、通常の出版契約では、第三者による出版物の利用については、対応できません。出版界の主導的な人たちはこの状態を長らく放置してきました。放置すべきしかるべき理由があったのかもしれません。 ２つのことが必要です。 一つ目は、出版社の権利（パブリッシャーズライツ）を早急に確立することです。 そのためには、著作権法の改正が必要です。 二つ目は、個々の出版契約によって、本の権利を守っていくことです。 JPCAは、2004年に、出版契約書を作成しました。これは、単に本を出版するという契約ではありません。様々な、第三者による著作権使用についても規定しています。法的確立がない現状では、個別の出版契約で、権利を保全していく以外に出版物の権利は守れないのです。今から始めても決して遅くはありません。 そして、全出版界の声として、出版社の権利（パブリッシャーズライツ）の法的保証を実現していきましょう。 2009年4月2日 JPCA（有限責任中間法人 日本出版著作権協会） | |
